GENERAL CONDITIONS OF SALE

Art. 1 – Acceptance of the general conditions of sale and conclusion of the contract

The contract stipulated between Eu Cosmesi di Cesoni Raffaello & C. sas (hereinafter “Sonia Olivieri”) and the Customer (i.e. the subject, natural person, who makes the purchase on the Site, not referable to their commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even partial, of the order by Sonia Olivieri. In the event of non-acceptance of the order, Sonia Olivieri will in any case provide timely communication to the Customer.

By placing an order in the various ways provided, according to the order form on the Site (hereinafter the "Order"), the Customer declares that he has read all the information provided to him during the purchase procedure and that he fully accepts these general conditions (hereinafter the "Conditions").

These Conditions may be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

Art. 2 – Purchase methods

The products offered for sale by Sonia Olivieri are only those present on the Sonia Olivieri website at the time the Order is placed, as described in the relevant information sheets.

In any case, it is understood that the images accompanying the description of a product are for information purposes only and may not be perfectly representative of its characteristics but may differ, for example, in color and size (also due to the browser and monitor used to access the Site and view the images).

To place an Order, the Customer must fill out the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products that he/she intends to purchase. The Customer must also request Sonia Olivieri, if desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 DpR n. 633/1972.

Correct receipt of the Order is confirmed by Sonia Olivieri by means of an e-mail response, sent to the e-mail address communicated by the Customer. This confirmation message will briefly report the conditions of purchase, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate without delay the necessary corrections of incorrect data.

Art. 3 – Prices and Payment Methods

The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions.

The following payment methods are available:

PayPal

For payment, the customer can use the Paypal circuit according to the specific methods of the same.

Credit card

In the case of purchase of goods with Credit Card payment method, the transaction may take place through the secure server of Stripe or another secure server chosen by Sonia Olivieri. In no case and at no stage of the payment will Sonia Olivieri be able to know the information relating to the Customer's credit card, transmitted via a secure connection directly to the site of the banking institution that manages the transaction. No computer archive of Sonia Olivieri will store such data and therefore in no case can Sonia Olivieri be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment

Art. 4 – Delivery of products and related costs

The purchased products will be delivered to the address indicated by the Customer in the Order within the terms indicated on the Site from the acceptance of the Order by Sonia Olivieri at the cost specifically indicated on the Site before sending the Order. When activated, Sonia Olivieri reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries to be made outside the Italian borders, shipping costs and delivery times may vary.

For deliveries requested in countries outside the European Union, any import customs charges will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of his/her country in advance to verify the costs and any import limits.

The delivery times indicated by Sonia Olivieri must be considered as purely indicative and a delay with respect to the same, or any delivery made with subsequent fractional shipments does not entitle the Customer to refuse the delivery itself and to request compensation or indemnity.

Upon delivery of the products, the Customer is required to check:

- that the number of packages delivered corresponds to that indicated in the transport document.
- that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal straps).
- that the cosmetic is in good condition and has the organoleptic characteristics declared by the manufacturer.
Any damage to the packaging and/or the product or any discrepancy in the number of packages or indications must be immediately reported by making a specific note on the delivery document of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods set out in this document.

Art. 5 – Right of withdrawal

Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

To exercise the right of withdrawal referred to in the previous article 5, the Customer must send Sonia Olivieri a communication to this effect, within the terms indicated, to the following email address customercare@soniaolivieri.com.

In case of withdrawal, the Customer must send it back within 14 (fourteen) days of the withdrawal to the following address:

The return for residents in Italy costs 7.50 euros, for Sicily, Sardinia and Calabria it costs 8.50 euros, in Europe 20 euros, in the United States 42.30 euros and in the Dominican Republic 66.24 euros.

The right of withdrawal may apply to the intact product returned in its original packaging; the shipment, until the certificate of receipt in the warehouse indicated by Sonia Olivieri, is under the complete responsibility of the customer.

Sonia Olivieri will refund the Customer the entire amount already paid, within 14 (fourteen) days of withdrawal, through a reversal procedure of the amount charged, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not bear any costs as a consequence of said refund. Sonia Olivieri may suspend the refund until receipt of the product.

In the event of damage to the goods during transport, Sonia Olivieri will notify the Customer, to allow him to promptly file a complaint against the courier chosen by him and obtain the relevant reimbursement; the product will then be made available to the Customer, simultaneously cancelling the request for withdrawal;
Sonia Olivieri will not be liable in any way for damage, theft or loss that may occur.

Art. 7 – Privacy

The personal data collected by forwarding the Order will be processed by Sonia Olivieri for the sole purpose of satisfying the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the privacy policy on the site. Any further processing will be carried out only with the express consent of the Customer.

Art. 8 – Applicable law

The sales contract referred to in these Conditions and its execution are governed by Italian Law, with the non-application of the conflict rules and the United Nations Convention on Contracts for the International Sale of Goods. The Court of the municipality of residence of the Customer will be competent for the resolution of the related disputes.

Art. 9 – Copyright

Brands, logos and other distinctive signs present on the site belong to their respective owners. The use of brands, logos and other distinctive signs is prohibited, including reproduction on other websites by unauthorized third parties. The contents of the site are protected by copyright (texts, images and graphics).

Art. 10 – Agreement

The contract supersedes all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the subject matter of the contract, together with the order, the general conditions relating to the use of the site and the conditions relating to the registration service. Any variation or modification of the contract must be accepted in writing by both parties.

Art. 11 – Communications

All communications between the parties must be in writing and sent to the other party's address indicated in the contract and in the order. Communications sent to the other party's email address, indicated on the site and in the order, are also considered to be sent in writing.

Communications relating to the validity or existence of this agreement must be exclusively delivered by hand or sent by registered letter with acknowledgement of receipt.

Art. 12 – Language

The sales contract is drawn up in two versions: Italian and Spanish in the Spanish language section of the Site. In the event of discrepancies in the translation, the Italian language version will prevail.
